Introduction

Get HiFy Club Private Limited ("Company", "we", "our", or "us") operates the HiFy mobile application and website (collectively referred to as the "Platform") to provide users ("you", "your", or "Users") with access to video content, highlights, images, statistics, and data generated during gameplay recorded at participating turfs, arenas, clubs, or grounds ("Facilities").

By using the Platform or services offered by the Company, you agree to the collection, use, disclosure, and processing of your information in accordance with this Privacy Policy.

1. Information We Collect

1.1 Personal Information

• Name, phone number, and payment information
• User account details
• Identity verification information (if applicable)

1.2 Gameplay Content and Data

• Video and audio recordings of gameplay
• Photographic content
• Game statistics and performance metrics
• User-generated data and highlights

1.3 Technical and Usage Information

• Device information (IP address, device type, OS)
• Usage data, including pages visited, time spent, and app interactions
• Cookies and similar technologies (where applicable)

1.4 Behavioral Analytics Data

• Clickstream events and user interactions within the app
• Feature usage patterns and navigation behavior
• Event timestamps and session information
• App performance metrics and crash reports

Important: We do not send personally identifiable information (PII) such as names, email addresses, or phone numbers to our analytics provider. All behavioral data is collected and processed in an anonymized manner.

2. Purpose of Collection

We collect and use your data for the following purposes:

• To provide and maintain the Platform and its services
• To process payments and deliver content
• To generate insights, highlights, and statistics from gameplay
• To communicate with users regarding updates, promotions, and service-related information
• For internal analytics and business improvement
• To analyze user behavior, app usage patterns, and feature engagement to improve user experience and app functionality
• To comply with legal obligations and regulatory requirements
• To use anonymized or de-identified gameplay footage and motion data for the research, development, and training of artificial intelligence and machine learning models, either by HiFy or by authorized third-party partners — as further described in Section 4A below

3. Consent and Lawful Basis

By using the Platform and providing your information, you consent to the collection and processing of your data as outlined in this Policy. Our lawful basis for processing includes your consent, fulfillment of contractual obligations, and compliance with applicable laws.

4. Disclosure and Use of Gameplay Content

By using our services, you acknowledge and agree that:

• All gameplay footage, highlights, images, and statistics recorded at the Facilities using our equipment may be owned or co-owned by Get HiFy Club Private Limited.
• We reserve the right to use, share, publish, sell, license, or otherwise distribute such content across our platforms, including but not limited to our social media channels, websites, marketing materials, and third-party partners.
• Users may access and download their personal gameplay footage upon payment of the applicable fee.
• Any commercial use by Users of such content shall require prior written consent from the Company.

4A. Use of Gameplay Data for Artificial Intelligence and Machine Learning

By using our Services and recording gameplay at any HiFy-enabled Facility, you explicitly acknowledge and consent to the following:

• AI Training Use by HiFy: HiFy may use your gameplay video footage, motion data, and associated metadata (collectively, "Gameplay Data") to research, develop, train, test, and improve artificial intelligence and machine learning models, including but not limited to models for action recognition, pose estimation, player movement analysis, and sports performance analytics.
• AI Training Use by Third-Party Partners: HiFy may license or otherwise make available your Gameplay Data to trusted third-party companies, including AI research laboratories, sports technology companies, and data analytics firms, for the purpose of training, fine-tuning, or evaluating AI and machine learning models. Such partners are contractually obligated to use the data solely for the permitted purposes and in accordance with applicable data protection laws.
• Anonymization: Where technically and commercially feasible, HiFy will anonymize or de-identify Gameplay Data prior to sharing it with third-party AI partners, such that individual players cannot reasonably be identified from the data provided. However, in certain licensing arrangements where identity-linked data is required, such data will only be shared with your explicit, separately obtained consent.
• No Sale of Personal Identity: HiFy will not sell or license your personally identifiable information (such as your name, phone number, or contact details) to third-party AI companies without your express prior consent.
• Field-of-Use Restrictions: All third-party partners receiving Gameplay Data for AI training purposes are restricted from using such data for purposes other than AI model training and evaluation, and may not redistribute, resell, or sub-license the data without HiFy's prior written consent.
• Opt-Out Right: You may opt out of having your Gameplay Data used for third-party AI training at any time by submitting a written request to privacy@gethify.com. Note that opting out does not affect HiFy's right to use your data for its own internal AI development or for providing the core Services.

5. Data Sharing and Transfers

We may share your data:

• With service providers involved in payment processing, cloud storage, analytics, and customer support
• With Facilities or partners involved in the content generation and user experience
• With AI research labs, machine learning companies, and data licensing partners for the purposes described in Section 4A
• With legal or regulatory authorities when required by law
• In connection with any merger, acquisition, or business restructuring

All data sharing is done in compliance with applicable data protection laws.

5.1 Analytics Provider

We use Mixpanel, an analytics service, to collect and analyze behavioral data about how users interact with our app. This includes clickstream events, feature usage, and user engagement metrics. Mixpanel processes this data in accordance with its privacy policy and applicable data protection laws. We do not transmit any personally identifiable information (PII) to Mixpanel.

6. Data Retention

We retain personal data for as long as necessary to provide the services, comply with legal obligations, resolve disputes, and enforce agreements. Gameplay content may be retained for archival, marketing, AI training, or business use unless a deletion request is submitted and deemed applicable.

7. User Rights

Users have the right to:

• Access and review their personal data
• Request corrections or updates
• Withdraw consent (where applicable), including consent to third-party AI data licensing as described in Section 4A
• Opt out of having Gameplay Data used for third-party AI training purposes
• Request deletion of personal data, subject to contractual and legal limitations

8. Security

We implement appropriate technical and organizational security measures to protect personal and gameplay data against unauthorized access, disclosure, alteration, or destruction.

9. Children's Privacy

Our services are not intended for individuals under the age of 13. We do not knowingly collect data from children without parental consent.

10. Updates to this Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page and, where appropriate, notified to you. Continued use of the Platform constitutes acceptance of the updated Policy.
